Action for wrongful death in the district court for Hennepin county by the special administratrix of the estate of George Spring-steen, whose death is alleged to have resulted from the negligence of defendant street railway company in the maintenance of its tracks and of the defendant Orlo Fry, one of its motormen, in the operation of one of its streetcars. The case was tried before Paul S. Carroll, Judge, and a jury, which returned a verdict of $10,000 for plaintiff. From an order denying their motion for judgment notwithstanding the verdict or a new trial and granting a new trial on the issue of damages only, defendants appealed.
